The distribution or display of constitutionally protected conduct cannot be elevated to a criminal offense solely because of how the person viewing it reacts, yet this bill would unconstitutionally punish individuals based on a prediction of how they respond to certain types of protected speech.

DUI Fees (H 7171, Article 6)

Though the ACLU recognizes the importance of substance abuse education, this proposed article in the FY 2021 budget would fund such programs by implementing a hefty financial penalty on those convicted of either a DUI or refusal to submit to a breathalyzer to fund those programs.
