In a brief filed today, the ACLU of Rhode Island has asked the Superior Court to reject a claim made by the R.I. Department of Corrections (DOC) that inmates serving life sentences at the ACI have no legal right to sue for any violation of their civil rights.  In a related letter sent today to Governor Gina Raimondo, the ACLU of RI also asked her to intervene and call upon the DOC to refrain from taking this position in future inmate civil rights lawsuits.

Arguing that Providence police have “utterly and completely fail[ed] to establish any legitimate governmental interest—let alone a ‘significant’ one—to justify their conduct,” the Rhode Island ACLU has asked a federal court to rule that police engaged in a clear violation of the free speech rights of a local resident in 2010 when she was barred from peacefully leafleting on a public sidewalk in front of a building where then-Mayor David Cicilline was speaking. In a 47-page brief filed today by RI ACLU volunteer attorney Richard A. Sinapi, the ACLU also seeks a court order requiring city officials to appropriately train and supervise police officers on the First Amendment rights of individuals to peaceably distribute political flyers.

The Rhode Island ACLU is asking a R.I. Superior Court judge to enjoin certification of the results of a “preliminary election” being held today to winnow down the list of candidates to appear on the November ballot for non-partisan at-large school committee seats in Lincoln. In a lawsuit filed yesterday on behalf of town residents John Cullen and Edward Slattery, ACLU volunteer attorney Annie Goldberg argues that the Town had no authority to hold such an election, and that all the qualified candidates should be eligible for the November ballot.

The ACLU of Rhode Island has called on the Coventry School Committee to abandon its practice of barring community members from speaking about “personnel, litigation or negotiation” during the public comment portion of its meetings.  In a letter sent to the school committee and its solicitor, the ACLU argued that the policy was clearly unconstitutional.

Calling the controversy “one of the most significant challenges to the public’s right to know under the state’s Access to Public Records Act” since its enactment, the ACLU of Rhode Island today filed an appeal to the R.I. Supreme Court on behalf of former House Minority Leader and Gubernatorial candidate Patricia Morgan, whose access to documents pertaining to the Attorney General’s expenditure of more than $50M in funds from the “Google settlement” has been stymied by hundreds of questionable redactions.
