We supported legislation which would bar state and local police from voluntarily agreeing to participate in federal civil immigration enforcement absent a judicial warrant or court order. This legislation would prohibit state agencies and departments from entering into an agreement under 8 U.S.C. §1357(g). The most common of these agreements is known as a §287(g) agreement. A 287(g) agreement is an agreement between the federal government, through Immigration and Customs Enforcement (ICE), and a state or local law enforcement agencies. This agreement deputizes and authorizes the local law enforcement agency to act as federal immigration enforcement, which does not normally fall within the scope of local policing authority.
