The Rhode Island ACLU has asked the state Department of Health to reconsider an order it issued against Rhode Island Hospital on November 2nd, requiring video and audiotaping of surgeries at the facility.

Saying that the City’s action “raises serious constitutional concerns,” the Rhode Island ACLU has called on Pawtucket Mayor James Doyle to rescind a decision that has prevented a sexuality education center from opening in the city. In a letter to the Mayor released today, Rhode Island ACLU executive director Steven Brown labeled as “pretextual” the city’s purported reasons for barring the center from operating in Pawtucket.

The Rhode Island ACLU today filed a federal lawsuit against the City of Pawtucket, charging that the Parks and Recreation Division has, for a number of years, given preferential treatment to parochial schools over public schools in granting permits for the use of city athletics fields. The lawsuit, filed on behalf of seven Pawtucket parents and their children, seeks a court order declaring unconstitutional both the preferential treatment to religious schools and the City’s lack of any objective standards for granting permits for use of the fields.

The American Civil Liberties Union of Massachusetts has filed a habeas corpus petition asking a federal court to release Rhode Island resident Richard Hatch from jail in Barnstable County.  Mr. Hatch was arrested and is being held in jail for talking to members of the media about his tax evasion case without getting formal approval from the federal Bureau of Prisons.  The petition follows unsuccessful efforts by the Rhode Island ACLU to have the disciplinary charges against him dismissed.  Mr. Hatch gained notoriety for having won the first season of the television show "Survivor," and for the legal battle regarding his taxes that ensued.

The Rhode Island ACLU today announced the settlement of a federal lawsuit it filed last October against the Town of West Warwick, challenging on free speech grounds the enforcement of an ordinance that significantly limited the posting of political signs. The suit was filed by ACLU volunteer attorney Richard Sinapi on behalf of local resident Thomas K. Jones, who at the time was both a state legislative candidate and an outspoken critic of plans to develop a water park in the town.

In a case raising important issues of freedom of speech, the Rhode Island ACLU has intervened in Family Court on behalf of a Barrington woman who has been barred by the Court from posting on the Internet any details about a pending Family Court custody proceeding in which her brother is involved. In a motion filed with the Court, RI ACLU volunteer attorney H. Jefferson Melish calls the ban a violation of Michelle Langlois’ First Amendment rights. The motion also argues that the Family Court had no jurisdiction to issue the order because the proceeding was filed in Kent County, even though neither party lives in that county.

Saying that the documents could “chill some individuals from engaging in peaceful protest activities,” the RI ACLU today called on Providence Mayor David Cicilline to remove from the City’s website a “protester registration form” and “public viewing guidelines” in anticipation of expected protests during the U.S. Conference of Mayors being held downtown this weekend.
