The Rhode Island ACLU has today filed a federal lawsuit charging Providence police with violating the free speech rights of a local resident in February when she was stopped from peacefully leafleting on a public sidewalk in front of a building where Mayor Cicilline was speaking.

The Town of North Kingstown has agreed to the entry of a temporary restraining order limiting enforcement of a constitutionally problematic political sign ordinance that the Rhode Island ACLU challenged in federal court on Wednesday. The agreement eliminates the need for a planned court hearing this afternoon on the ACLU’s request for a restraining order.

The Rhode Island ACLU today filed a federal lawsuit against the Town of North Kingstown, challenging an ordinance that discriminatorily limits the posting of political signs in the town. The suit was filed by ACLU volunteer attorney Richard A. Sinapi on behalf of independent Congressional candidate John O. Matson, who was forced to take down a number of his political signs this month after being notified that they violated the town’s zoning restrictions on the size and placement of such signs.

Claiming that the Narragansett Police Department has “set a very dangerous precedent that could have a significantly chilling effect on freedom of speech by town residents,” the Rhode Island ACLU has called on the town’s Police Chief to drop criminal “cyberstalking” charges recently lodged against two town residents in separate incidents. The charges stem from vulgar comments the residents made about two local politicians on a Craigslist website devoted to “rants and raves.”

In a letter faxed today to Coventry School District Superintendent Kenneth DiPietro, the Rhode Island ACLU called for an immediate revision to the school’s dress code policy, which apparently bans students from displaying any images of weapons. Pointing to this week’s highly-publicized incident when eight year old student David Morales was barred from wearing a patriotic hat because it included toy soldiers carrying guns, the ACLU called the dress code clearly unconstitutional. The RI ACLU letter, from executive director Steven Brown, noted:

The RI ACLU today announced the favorable settlement of a federal lawsuit it filed last year against the Town of Johnston and police chief Richard Tamburini for illegally releasing the private drivers’ license information of a firefighter to a Town Councilman as part of a public dispute between the Council and the Fire Department. The lawsuit, filed by RI ACLU volunteer attorney James Kelleher, was on behalf of the firefighter, Edward Simone.

The RI ACLU has filed a federal lawsuit against the Town of Johnston and police chief Richard Tamburini for illegally releasing the private driver's license information of a firefighter to a Town Councilman as part of a public dispute between the Council and the Fire Department. The lawsuit, filed by RI ACLU volunteer attorney James Kelleher, is on behalf of town resident and firefighter Edward Simone, who was the victim of the disclosure.

The Rhode Island ACLU has asked the state Department of Health to reconsider an order it issued against Rhode Island Hospital on November 2nd, requiring video and audiotaping of surgeries at the facility.

Saying that the City’s action “raises serious constitutional concerns,” the Rhode Island ACLU has called on Pawtucket Mayor James Doyle to rescind a decision that has prevented a sexuality education center from opening in the city. In a letter to the Mayor released today, Rhode Island ACLU executive director Steven Brown labeled as “pretextual” the city’s purported reasons for barring the center from operating in Pawtucket.
