  • Bill Number: H 7629
  • Session: 2024

due process

We opposed this bill, noting that the complete abandonment of any statute of limitations hobbles the due process rights of ciriminal defendants.

This bill would completely eliminate the statute of limitations against individuals charged with second degree sexual assault. We opposed the bill, noting the importance of reasonable statutes of limitations to protect a defendant's due process rights and pointing out it has been more than three decades since a crime had been added to the state's list of offenses that can be charged at any time. This bill passed the House, but died in the Senate.
