In April, the ACLU testified before the House Judiciary committee in support of legislation to clarify the law protecting medical marijuana patients from discrimination by their employers. Despite a clear statute barring discrimination in employment against medical marijuana cardholders, some employers have believed that denying employment to medical marijuana patients for failing drug tests does not constitute discrimination. A Superior Court judge has already sided with the ACLU in one case against such an employer; this bill would clarify any confusion in the law and keep cardholders who do not use on the job and are not working while impaired from facing undue employement discrimination.
