Judge Orders Release of Unlawfully Incarcerated Juvenile Offenders

R.I. Superior Court Judge Stephen Nugent today ordered the release on parole of three individuals who were convicted of crimes committed when they were teenagers and who were recently granted parole, but who nonetheless continued to be held at the ACI.

ACLU Sues Department of Corrections Over Unlawful Incarceration of Juvenile Offenders

ACLU of Rhode Island cooperating attorneys filed two petitions in R.I. Superior Court today, claiming that the R.I. Department of Corrections (DOC) is unlawfully keeping in prison individuals who were convicted of crimes committed when they were juveniles or very young adults. The legal action claims that the DOC is violating a law enacted by the General Assembly last year that targeted lengthy sentences meted out to young offenders and explicitly sought to help them get early release from those sentences.

ACLU Charges State with Undermining Law Designed to Reduce the Incarceration of Juvenile Offenders

The State’s argument, taken to its logical conclusion, would be that the Youthful Offender Act is not applicable—at all—to any person sentenced on multiple offenses, even those running concurrently, since that person has not been convicted of “an” offense.
