ACLU Settles Suit on Behalf of ACI Inmate Retaliated Against for Criticizing Prison Policies
The American Civil Liberties Union of Rhode Island today announced the settlement of a federal lawsuit on behalf of Jason Cook, an ACI inmate who, the suit alleged, was the victim of retaliation by prison officials for publicly criticizing RI Department of Corrections’ (DOC) mail policies and seeking legal assistance from the ACLU. Under the settlement, the DOC, while denying any liability, has agreed to pay a total of $7,500 in damages and attorneys’ fees.

Judge Rules that Retaliation Lawsuit Against Department of Corrections Can Proceed
A federal judge yesterday refused to dismiss an ACLU lawsuit brought on behalf of an ACI inmate who was retaliated against by guards after he publicly criticized Department of Corrections’ mail policies and sought legal assistance from the ACLU (see the ruling and the report and recommendation). The pattern of harassment against inmate Jason Cook, which included strip searches, loss of his prison job, destruction of his personal property, and disciplinary time in segregation, began after Cook was quoted in a Providence Journal story criticizing a DOC policy limiting the written materials available to inmates. The policy was later rescinded.

ACLU Sues Department of Corrections for Retaliating Against Inmate Who Criticized Prison Policies
The Rhode Island ACLU has today filed a federal lawsuit against the Department of Corrections (DOC), alleging that correctional officials have engaged in a pattern of unconstitutional harassment against inmate Jason Cook after he publicly criticized Department of Corrections’ mail policies and sought legal assistance from the ACLU. The lawsuit, filed by ACLU volunteer attorneys from the law firm of DeLuca and Weizenbaum, details a series of retaliatory and disciplinary actions against Cook who, until he spoke out, had a relatively clean disciplinary record.
