Budget articles passed by the legislature took some positive steps in addressing the continued overcrowding problem at the R.I. Training School, which had been the subject of an ACLU lawsuit. Legislation enacted this year sets a population cap for the new Training School facilities, and also requires the state to use a risk assessment instrument in making detention determinations. As a result, only juveniles who are found to pose a danger to themselves or others will, at least in theory, now be held at the Training School.
